These Terms of Service ("Terms") are an agreement between you and Adriatic Mediation LLC ("Adriatic," "we," "us," or "our"). By creating an account, clicking to accept, or using DivorceNavigator.ai or the Divorce Navigator workspace (the "Service"), you agree to these Terms, our Privacy Policy, and our Disclaimer. If you do not agree, do not use the Service. You must be at least 18 years old and legally able to enter a contract to use the Service.
Divorce Navigator is a planning, organization, and communication tool. Adriatic is not a law firm, and the Service is not a substitute for a licensed attorney, accountant, tax adviser, financial adviser, mental-health professional, or other qualified professional. Nothing in the Service, including templates, checklists, automated features, or AI-generated material, is legal advice or creates an attorney-client, solicitor-client, fiduciary, or other professional relationship. Obtain advice specific to your circumstances before making legal or financial decisions.
Provide accurate information and keep it current. You are responsible for your credentials, activity under your account, and maintaining the security of your devices. Do not share your password. Notify us promptly at contact@adriaticmediation.com if you suspect unauthorized access. When you invite another person to a workspace or upload information about them, you represent that you have the authority or lawful basis to do so. Information added to a shared workspace may be visible to the people you invite; do not use the Service to reveal information you are not permitted to share.
You may use the Service only for lawful, personal, or authorized professional purposes. You may not:
You retain your rights in information and documents you submit ("User Content"). You grant Adriatic a limited, non-exclusive license to host, reproduce, transmit, format, secure, and process User Content as necessary to provide, maintain, troubleshoot, and improve the Service, respond to legal requests, and enforce these Terms. This license ends when the content is deleted, except for copies retained under the Privacy Policy or required by law. You are responsible for User Content and for obtaining permissions required to submit it.
The Service, its software, design, trademarks, documentation, and original content are owned by Adriatic or its licensors and are protected by applicable law. We grant you a limited, revocable, non-transferable license to use them for the permitted purpose of the Service. No other rights are granted.
If a feature requires payment, the applicable checkout or order page will identify the price, billing frequency, taxes, and any additional terms before you purchase. You authorize the payment provider to charge the selected payment method. For recurring plans, you may cancel before the next billing period through the available account controls or by contacting us. Cancellation generally takes effect at the end of the paid period, and fees already charged are not refundable except as stated at checkout, required by law, or approved by us. Payment providers may apply their own terms and privacy policy.
The Service may change, be interrupted, or become unavailable for maintenance, security, circumstances beyond our control, or other reasons. We do not guarantee that it will be uninterrupted, error-free, complete, or available in every location. The Service may include links, integrations, payment processing, hosting, communications, or other features provided by third parties. Those third parties are responsible for their own services and terms.
Automated and AI-assisted features can produce inaccurate, incomplete, outdated, or inappropriate results. Review every output independently and do not treat it as professional advice, a statement of law, or a reliable calculation. Do not submit an AI-generated document to a court or sign an agreement without review by an appropriate qualified professional.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS. WE DO NOT WARRANT THAT CONTENT IS CURRENT, COMPLETE, OR SUITABLE FOR YOUR LEGAL, FINANCIAL, FAMILY, OR OTHER CIRCUMSTANCES. YOUR USE OF THE SERVICE AND RELIANCE ON ANY CONTENT ARE AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADRIATIC AND ITS OWNERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR $100. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW OR TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Adriatic and its personnel and service providers from claims, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your User Content, your misuse of the Service, your violation of these Terms, or your violation of another person's rights.
You may stop using the Service and close your account at any time through available account controls or by contacting us. We may suspend or terminate access if you violate these Terms, create a security or legal risk, fail to pay applicable charges, or if we discontinue the Service. We may also restrict access when needed to protect users or investigate suspected abuse. Provisions that by their nature should survive termination, including ownership, disclaimers, liability limits, indemnification, and dispute terms, will survive. Data handling after closure is described in the Privacy Policy.
These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law rules. Subject to any rights that cannot be waived under the law where you live, you and Adriatic agree that state and federal courts located in Morris County, New Jersey have exclusive jurisdiction over disputes arising from the Service or these Terms, and each party consents to that venue. Nothing in this section limits a consumer's non-waivable rights under applicable law.
We may update these Terms when the Service, law, or our practices change. We will post the revised Terms and update the effective date. For material changes, we will provide additional notice where required, and continued use after the effective date means you accept the revised Terms. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. These Terms and the documents they incorporate are the entire agreement about the Service and replace prior agreements about the same subject.
